By using the InsurancePen Website (“Site”), you agree to be bound by these Terms of Use. If you do not agree with any part of these Terms of Use, you must not use the Site. Your continued use of the Site will constitute your acceptance of these Terms of Use, as may be modified by InsurancePen at any time without notice to you.
Permitted Use
InsurancePen operates an online insurance marketplace that enables consumers to comparison shop online and to obtain insurance company-sponsored quotes for a variety of insurance products, including automobile, homeowners, life, liability, workers’compensation, health and other commercial coverage. While quotes obtained through InsurancePen’s online insurance marketplace are provided to consumers free of charge, InsurancePen earns revenues from participating insurance providers or agents based on the delivery of consumer leads should they choose to enroll in our premium services. Because of this, all of the content in the Site is made available only for your personal, lawful, non-commercial use in connection with seeking insurance quotes and insurance related information. Unless agreed to in writing by InsurancePen, use of the Site by any competitor company or other non-consumer third party is strictly prohibited. Additionally, you may not, without our prior written permission: (i) link from another Website to the Site; (ii) post, transmit, copy, modify, create derivative works from, distribute, sell, or republish anything you obtain or download from the Site; or (iii) engage in systematic retrieval of data or other content from the Site.

Except as otherwise indicated, all materials in the Site, including without limitation the InsurancePen logo and other InsurancePen trademarks and service marks, are the property of DeRoches, LLC and/or its affiliates and are protected by international copyright and trademark laws, all rights reserved. Other service names presented on this site are service marks of DeRoches, LLC, except for those of insurance carriers, brokers, agents, industry organizations, service providers, associations and educational or government institutions, which are service marks of their respective entities.
Disclaimer of Warranties
All information, products, content and other materials in the Site is provided "as is" and without warranties or representations of any kind, either express or implied. InsurancePen does not represent or warrant that: (i) the operation of the Site will be error-free or uninterrupted; (ii) defects will be corrected; (iii) the Site, any e-mails sent by InsurancePen, or the server that makes the Site available are free of viruses or other harmful devices; (iv) the Site will be available to you or that you will qualify for products or services offered; (v) the materials in the Site will be accurate as of any particular date; or (vi) the products or services offered through the Site are available outside of the United States or in all jurisdictions (vii) that you will receive insurance quotes or responses from our carriers or groups.
Limitation of Liability
InsurancePen shall not be liable for any loss, damage, injury, or claim, nor any special, indirect, incidental, consequential, exemplary or punitive damages of any kind, whether such action is based in tort, contract, negligence, strict liability, or otherwise and even if InsurancePen has been advised of the possibility of such damages, which arises out of or relates in any way to: (i) the Site, materials in the Site, or the inability to use the Site; or (ii) any defect, omission, error, interruption, delay, or computer virus.
Jurisdiction, Enforceability, and Termination
These Terms of Use and your use of the Site are governed in all respects by the laws of the State of Michigan, without giving effect to any principles of conflicts of laws. Any dispute concerning the Site or these Terms of Use shall be subject to the exclusive venue of a court of competent jurisdiction in Oakland County, Michigan.
In the event that a court of competent jurisdiction holds any provision of these Terms of Use to be invalid or unenforceable, then such provision shall be severable from and shall not affect the validity or enforceability of the remaining provisions.
Website Notice
InsurancePen is an insurance marketplace where consumers can research their insurance choices, insurance group discount programs and insurance companies. InsurancePen does not recommend or endorse any specific insurance company and does not provide advice on which insurer to select or which products to buy.
Agency Licensing
InsurancePen is a service operated by DeRoches, LLC of Novi, MI. InsurancePen does not act as an insurer or licensed agency. InsurancePen is only a marketplace for consumers to find insurance products offered by licensed insurance agents and insurance carriers.
Any user of InsurancePen who creates groups warrants that they are (i) licensed as an insurance agent or carrier authorized to provide the products offered by the group listing (ii) the user is authorized on behalf of the insurance company and the licensed insurance agency to advertise the insurance product and (iii) the user is authorized to advertise the insurance product in the jurisdiction(s) they select for the group.

Accuracy
InsurancePen quotes are provided by insurance carriers and their licensed agents. InsurancePen can not verify the accuracy of the quotes provided by independent third parties insurance carriers or their licensed insurance agents. InsurancePen quotes from insurance carriers and their licensed agents use information consumers provide on our detailed questionnaires. However, these quotes could change based on additional or contradictory information that emerges during the final insurance underwriting process.
